11. Agreement to Terms
These terms of use ("Terms") govern the use of services made available on or through https://www.canyfix.com/ or mobile applications ‘CanyFix’ (the "Platform"). These Terms constitute a binding and enforceable legal contract between Badki Solutions Private Limited, a company incorporated under the Companies Act, 2013, and you, a user of the Services. By using the Services, you agree that you have read, understood, and are bound by these Terms.
22. Description of Services
The “Services” include the provision of the Platform that enables you to arrange and schedule different services for: (i) Mobile Repair: Comprehensive repair support for all smartphone and mobile models; (ii) Home Service Repair: On-demand services for electricians, plumbers, carpenters, and painters; (iii) Laptop Repair: Specialized support for battery, screen, and keyboard replacements. CanyFix facilitates connection with independent third-party experts (“Experts”) and collects payments on their behalf. CanyFix does not directly provide the repairs and is not responsible for their provision by Experts.
33. Camera and Video Diagnosis Consent
A critical feature of our Service is the ability to diagnose issues remotely via video call. You hereby consent to provide camera access to our Platform and Experts for: (i) Real-time video diagnosis to assess faults and provide cost estimates; (ii) Capturing images or videos of the device or home fixture to update booking status and document work quality. You acknowledge that if camera access is not provided, certain diagnostic features may not function, potentially affecting the accuracy of service quotes or our ability to deliver the Service.
44. User Registration and Responsibilities
To avail the Services, you must be at least 18 years of age and register an account. You are solely responsible for maintaining the confidentiality of your credentials. You warrant that all information furnished is accurate and true. You agree to receive communications from us regarding payments, service updates, and promotional offers via call, SMS, email, or WhatsApp.
55. Bookings and Cancellations
The Platform permits you to request various services based on available slots. Confirmation is subject to Export availability. Cancellations made before confirmation will not be charged. Cancellations after confirmation may attract fees as per CanyFix’s cancellation policy. If an Expert is unavailable, we will offer a substitute or reschedule the booking on a best-effort basis.
66. Pricing and Payment Terms
You shall be required to pay Expert charges, a Technology fee for platform facilitation, and any applicable Convenience or Surge fees. Taxes will be levied as per prevailing laws. Payments can be made via credit/debit cards, net banking, wallets, UPI, or Cash on Delivery (where applicable). Pricing estimates provided during video diagnosis are based on preliminary assessment and may be revised upon physical inspection.
77. Customer Conduct
CanyFix prohibits discrimination against Experts on any basis. You are requested to treat Experts with courtesy and provide a safe, clean location for physical service visits. Experts may refuse service if the environment is unsafe or if you are abusive. You agree not to solicit Experts independently outside the Platform; a violation of this may preclude you from future services.
88. Intellectual Property and Content
All rights in the Services and Platform are owned by Badki Solutions Private Limited. You are granted a limited, non-transferable license to use the Platform for personal use. User Content (reviews/feedback) submitted grants us a worldwide, royalty-free license to use such content for service optimization and advertising.
99. Disclaimers and Limitation of Liability
The Services are provided on an "as is" basis. While we strive for accuracy, CanyFix is a platform connecting users with Experts; we are not liable for the performance of repairs or any property damage caused by Experts. To the maximum extent permitted by law, our total liability shall not exceed INR 10,000.
1010. Jurisdiction and Dispute Resolution
These Terms shall be governed by the laws of India. Subject to arbitration provisions, courts in Kalyan, Maharashtra shall have exclusive jurisdiction. Any disputes shall be resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The exclusive jurisdiction for all legal matters will fall into the Kalyan, Thane Area.
